Israel Issues Bid for New Jewish East Jerusalem Neighborhood With Over 1,000 Housing Units

The Israel Lands Authority is soliciting bids to build 1,047 apartments in a new Jewish neighborhood of East Jerusalem.

The invitation to bid went out on Wednesday, just three months after the district planning community approved the new neighborhood – a very short time compared to other, similar projects.

The new neighborhood, called Amat Hamayim Hatachtona ("The lower watercourse"), will be located near Jerusalem's Har Homa neighborhood in the city's southeast. The plan also calls for building another 400 apartments there down the road.

Since the war in the Gaza Strip began on October 7, the planning authorities have accelerated work on plans to build new Jewish neighborhoods in East Jerusalem, despite the international criticism this engenders.

On October 9, the district planning committee allowed plans for the Kidmat Zion neighborhood, which will be located deep in Palestinian areas of the city, to advance to the next stage of the approval process.

Later, the committee approved plans for building a new neighborhood called Givat Hashaked near the Palestinian neighborhood of Sharafat. That plan was approved in just five weeks, despite the objections submitted to the committee.

In the subsequent months, other plans were also approved or advanced to the next stage of the process, including one to build four small neighborhoods in East Jerusalem. Unusually, that plan was proposed by the Justice Ministry's custodian general – which owns the land on which the projects will be built – in cooperation with real estate developers affiliated with the right. 

Like Givat Hashaked, these four neighborhoods will be adjacent to Palestinian neighborhoods.

A report by Ir Amim and Bimkom nonprofits, said that since October 7, planning agencies have advanced 17 master plans for Jews in East Jerusalem that encompass 8,434 apartments. The plans for almost 3,000 of these apartments have been submitted by the custodian general, which is responsible for managing Jewish assets abandoned when Jews were forced out of eastern Jerusalem during the 1948 War of Independence.

Some other plans would expand large Jewish neighborhoods in East Jerusalem, like Gilo and Pisgat Ze'ev, by replacing low-rise buildings with high-rise ones.

Til tross for at Israel i 1993 under Oslo-avtaleene skriftlig lovet at palestinske institusjoner i Øst-Jerusalem ... de skulle REPEKTERES, så har det MOTSATTE skjedd.
Dette skriftlige løfte ble gitt i brev fra Shimon Peres til Norges utenriksminister Joahn Jørgen Holst.

"During the Oslo negotiation, the PLO requested a written commitment from the Israeli side regarding the specific status of the Jerusalem institutions. This came on October 11, 1993, when Israeli Foreign Minister Shimon Peres sent a letter of assurances on the issue of Palestinian institutions in Occupied East Jerusalem to Minister Johan Jorgen Holst of Norway, after making a statement to the same effect in the Knesset on September 9, 1993. The letter reads: 

“I wish to confirm that the Palestinian institutions of East Jerusalem and the interests and well-being of the Palestinians of East Jerusalem are of great importance and will be preserved. Therefore, all the Palestinian institutions of East Jerusalem, including the economic, social, educational, cultural, and the holy Christian and Moslem places, are performing an essential task for the Palestinian population. Needless to say, we will not hamper their activity; on the contrary, the fulfilment of this important mission is to be encouraged ."

Utkastelse i Øst-Jerusalem etter 70 år

Familien Bar Laban er kastet ut fra sitt hjem i Øst-Jerusalem etter å ha bodd der i 70 år.
Leiligheten er overtatt av en israelsk stiftelse basert på israelsk lovgivning om eiendomsrett fra før 1948.
Denne retten gjelder bare for eiendommer eid av jøder.

Det må tas med at Øst-Jerusalem er okkupert område, ulovlig annektert av Israel.
Og at den angitte israelske lovgivning om eiendomsrett der er ugyldig.

Following an 18-year legal battle, members of a settler organization have moved into the Petra Hotel in Jerusalem’s Old City.

Currently, Ateret Cohanim occupies only part of the Petra Hotel, but Christians in Jerusalem consider the hotel a strategic building that could affect the character of the Old City’s entire Christian Quarter.

Located near Jaffa Gate, the hotel is one of two large buildings the organization bought from the previous Greek Orthodox patriarch, Irenaios, in a controversial deal. The other is the nearby Imperial Hotel.

When the deal came to light in 2005, it sparked a major crisis within the local branch of the Greek Orthodox church that culminated in Irenaios’ unprecedented dismissal. His replacement, Theophilos III, then tried to repudiate the deal and get it overturned.

But the Jerusalem District Court, and later the Supreme Court, ratified it, despite concluding that there were “shadows and black holes in the moves that led to the agreement’s signing.” Among other things, it was proven that Ateret Cohanim had paid a church official.

The patriarchate then asked the district court for a retrial. Its request was based on an affidavit by Ted Bloomfield, who had worked for Ateret Cohanim in the 1990s and said the organization had regularly paid bribes to senior church officials. He also said it had offered sexual bribes and that an assessor’s valuation of the property had been concealed from the court.

But in 2020, Judge Moshe Bar-Am ruled that the patriarchate submitted this affidavit too late. He said it could have submitted the document even before the original hearing in the Jerusalem District Court, as evidenced by the fact that Bloomfield’s claims had been reported by Haaretz two and half years earlier. He also said Bloomfield’s affidavit didn’t relate directly to the 2004 sale of the hotels, but to earlier deals that never went through.

The patriarchate has appealed this decision, too, and the Supreme Court is expected to hear the appeal in another few months.

Ever since its victory in the district court, however, Ateret Cohanim has been waging a separate legal battle against the Qiresh family, which runs the hotel under a lease from the patriarchate. And Sunday morning, Ateret Cohanim members entered the building’s first floor under police escort. Under the terms of the lease, this floor is separate from the rest of the hotel, which is why the organization was able to take possession.

Lawyers for the Qiresh family, Medhat Deeba and Maher Hanna, argued that the settlers were in fact trespassing, but said the police refused to even listen to them. They also said one of the settlers attacked Deeba with pepper spray and that police then detained Deeba and took him to the station for questioning.

Police said he isn’t suspected of anything and was only taken there to give a statement.

"A few days ago, 22 European diplomats visited the site, as part of the increasing media and diplomatic interest in the issue.

Burgsdorff said on the visit that he was “shocked” and urged Israel to halt the eviction.

“Eleven people living in the Salem family’s house are being threatened with eviction in the next few days, during Christmas and in the middle of the winter. For me, as a Christian, this is hard to conceive. This is occupied territory. People have a full right to live here. They were evacuated in 1948 from West Jerusalem and found shelter here. And after 70 years the authorities want to evict them again and turn them into refugees once more. This is inhuman and unfair. I’m here to express our frustration and anger,” he said."

A court halted the evacuation of a Palestinian family from their home in the East Jerusalem neighborhood of Sheikh Jarrah on Thursday, after police asked the court registrar to postpone the eviction, citing a security risk.

Earlier this week, the head of the European Union’s mission to the West Bank and Gaza Strip, Sven Kuhn von Burgsdorff, visited the Salem family, who have been living in their home in Sheikh Jarrah for the past 70 years. He blasted the eviction, calling it “inhuman and unfair.”

The authorities, equipped with a writ of execution, were scheduled to evict the Salems next week so that Jews could move into the house.

Before 1948 the house had belonged to a Jewish family, and the Salem family leased the house from the Jordanian custodian of enemy property from 1951.

After the Six Day War the house passed to the Israeli Custodian General, who returned it to its Jewish heirs. The lawyers acting for the Jewish heirs were financed by a right-wing NGO working to evict Palestinians and populate the neighborhood with Jews.

Some of the Jewish heirs sold their part of the property to the NGO. Recently right-wing activist and city council member Yonatan Yosef bought the rights to the building.

Two weeks ago, Yosef and another council member, deputy mayor Arieh King, served the eviction order to Fatima Salem, 72, who has lived in the house her entire life. Ten family members, including four children, live in the house.

The verdict to evict the house so that Jews could move into it was issued in 1988, but since then the settlers did little to drive the Palestinian family out of their home.

The house is located in the neighborhood’s western part, called Um Haroun. Recently tensions have been running high over the evacuation of Palestinian families in the east of the neighborhood, where residents are awaiting Israel's Supreme Court’s verdict after having turned down the justices’ compromise proposal.

The evacuation order says the family must evacuate the house by December 29. But on Thursday, lawyer David Hershkowitz, who represents Yosef, requested the execution authorities to postpone the evacuation and give them the option to evacuate the family at any time from January 20 to February 8. He attached a letter from the police asking to delay the evacuation.

“In keeping with recent goings-on in Jerusalem in general and in the Shalem station in particular, implementing the order at a specific date or a close date known in advance could endanger the forces and foil the evacuation’s success,” wrote Chief Inspector Eliran Hazan.

Court Registrar Idit Gur-Arie agreed to put off the evacuation and scheduled a hearing on the request to issue another order next Thursday.

Burgsdorff said on the visit that he was “shocked” and urged Israel to halt the eviction.

For me, as a Christian, this is hard to conceive. This is occupied territory. People have a full right to live here. They were evacuated in 1948 from West Jerusalem and found shelter here. And after 70 years the authorities want to evict them again and turn them into refugees once more. This is inhuman and unfair. I’m here to express our frustration and anger,” he said

Lønnsom "ikke-planlegging" i Øst-Jerusalem?

Den israelske journalisten Amira Hass har en vinkling i en artikkel i Haaretz 13. desember 2021 der det hevdes at den konsekvent manglende byplanleggingen ("non-planning") i Øst-Jerusalem ... den er "lønnsom". Dvs lønnsom for Israel:
"Israel profits twice from Palestinians living in the capital: 
- once from the fines they pay for the city’s own crimes, 
- and again when the community is forced into a life of low-paying jobs and abject poverty".
 
Det er store størrelser det antydes i artikkelen (200.000 "ulovlige" boliger).
Og det gjør påstandene desto mer alvorlige.
 
Er det mulig å få ut proppen som hindrer reguleringsplaner i Øst-Jerusalem?
En internasjonal tilleggs-ressurs av profesjonelle byplanleggere i et eget prosjekt ... dedikert til å få ut proppen?

Ingen informasjon tillates av Israel om beslaglagte palestinske eiendommer

Etter israelsk lov fra 1955 beslaglegges alle palestinske eiendommer der eieren måtte ha flyktet eller oppholder seg utenfor Israel. Loven gjelder fortsatt ... og skaper store problemer ... spesielt i Øst-Jerusalem.

Dette er inngående beskrevet i nedenstående Haaretz-artikkel:

Det er forsøkt å få tilgang til informasjon om virksomheten til denne "Custodian of Absentee Properties".
Men israelske domstoler nekter innsyn .. med henvisning til at det vil skade Israels omdømme internasjonalt.  
Israels UD deltok i denne vurderingen ... og da konkluderte den israelske dommeren:
“I have been convinced that the disclosure of the requested information may jeopardize the state’s foreign relations,”..
 
Slik skjules virkeligheten
Og tilstanden for folk i Øst-Jeruslalem forverres.
Og dette gjelder noe så grunnleggende som eierskapet til huset du bor i. 

Israels annektering av Øst-Jerusalem er ulovlig etter internasjonal rett.
Bruk av loven fra 1955 i år 2021 er et klart brudd på både moral og jus.
 
Norsk UD må granske denne saken grundig.
Og bruke sin posisjon i UNSC.

Israel's Custodian of Absentee Properties is a powerful agency that manages hundreds of properties in East Jerusalem and shapes the city's real estate market — but power does not always mean knowledge.

Despite its vast sway, a recent hearing on a freedom of information request reveals the Finance Ministry department doesn't know how many properties it controls; or that finding the information is too complicated; or that revealing this information may compromise the country’s foreign relations – depends on which answer you choose to believe.

With the backing of the magistrate’s court judge, who decided not to force the custodian to disclose the information, one of the most contentious bodies in Israel has the license to remain opaque.

The Custodian of Absentee Property has been operating under the Absentee Property Law of 1950, which transfers to the state any property whose owner stayed in an enemy country during the temporary “state of emergency” – which is in effect until this day, renewed perfunctorily on a biannual and bipartisan basis. Through the law, the state has seized all the property left behind by Palestinian refugees in 1948. In a controversial expansion, the law was applied to East Jerusalem as well, after it was de facto annexed to Israel in 1967. This means that any property on the east side of Jerusalem belonging to somebody living in the West Bank or an Arab country is supposed to automatically devolve to the Custodian — and herein lies the problem.

The fear of the Custodian is one of the most impeding factors in the real estate market in East Jerusalem, with a far-reaching impact on the economy and city planning. As many Palestinian families have a relative who lives or lived in an Arab country, almost every piece of property in the east side can be claimed to have an owner who is an absentee, and therefore the Custodian should receive their share of the asset. Among other things, it causes many to prefer purchasing and selling realty on the black market, without notifying authorities, or to turn to illegal construction in order to avoid requesting a building permit.

“An unreasonable situation has developed where people fear to make deals on the east side,” says Att. Amir Adika Tal of Kadari, Shamir & Co. Law Offices, which has taken up the fight on the subject. “The resulting situation is that there is an enormous pool of houses and land that nobody is doing anything with, despite Jerusalem being desperate for land.” Even a massive land registration drive announced by the state some two and a half months ago was met with noncooperation, due to the same fear.

Against this backdrop, Ram Cohen, an attorney at Tal, Kadari, Shamir & Co. Law Offices and an urban planning student, decided to file a freedom of information request to establish how many properties are managed by the Custodian. The firm represented him in the petition, in an effort to uncover even a fraction of the goings-on at the Custodian’s office. Based on experience from a previously rejected petition, Cohen did not request the location of the properties or the identities of the owners, but only the number: How many properties are “assigned,” or supposed to be under the Custodian’s control, how many of these are managed by the Custodian in practice, and how many have been released to their owners or sold.

What ensued was a series of contradictory accounts. The Custodian first responded that the number of properties it owns cannot be given “due to the complexity of the requested information,” that there are no properties managed by it, and that it has no information on the scope of properties released or sold.

Just before the hearing on the petition at the Jerusalem Magistrate’s Court last June, the Custodian suddenly recalled that they do manage a single property: The Seven Arches Hotel on Mt. Olives in Jerusalem. At that time the Custodian devised a new reason to turn down the request: Revealing the information would compromise Israel’s foreign relations, which is considered a legitimate reason for authorities to decline requests to reveal information on their activities.

Ronen Baruch, the Custodian of Absentee Property since 2005, gave a different answer. He testified to the court that his unit has a staff of just three, only two of whom are professional. “Even thought we’re in 2021, our office isn’t digitized, and the material isn’t scanned,” he said on the stand, explaining that from 1967 to this day, no comprehensive survey has been conducted of the Custodian’s properties in East Jerusalem. He said that every year there are some 40 requests to release properties back to their owners, but he doesn’t know how many were approved. In response to a question by Judge Einat Avman-Muller, Baruch explained that in order to extrapolate the information about the number of properties, he has to pore over paper files.

The hearing also had a surprise attendee: Jonathan Rosenzweig, head of the Palestinian department at the Foreign Ministry. Despite objection by Cohen and Adika, the judge granted the Custodian’s request and allowed Rosenzweig to be heard ex parte. After this, the judge decided to reject the freedom of information request: “I have been convinced that the disclosure of the requested information may jeopardize the state’s foreign relations,” she wrote in her ruling. She fully accepted the Custodian’s explanations. “I am satisfied that delivery of the information will cause an unreasonable allocation of resources… Which may disrupt and even paralyze the Custodian’s work,” she wrote, adding that Cohen must pay the Custodian’s legal expenses, a sum of 10,000 shekels.

“What harms the state’s foreign relations? Revealing the information, or the very existence of the law, over 70 years after the country’s founding?” Adika asks. Cohen and Adika have recently filed an appeal of the decision to the District Court. The appeal was joined by former Deputy State’s Prosecutor, Shuki Lamberger. “This law is very powerful in regard to the state’s authority over people’s private property,” says Lamberger. “There is public and economic importance in knowing how it conducts itself with this power, how many such properties there are, how many they release, how many they sell. This is a very unconventional law. The impression is that they’re either presenting a very imprecise picture, or that they’re not managing at all."

The Finance Ministry, in response to a series of questions about the Custodian’s operations: “The state will respond in the proper jurisdictions.” The Foreign Ministry declined to comment.

Sheikh Jarrah i Øst-Jerusalem: Sakte etnisk rensing pågår

I områder i Øst-Jerusalem, som Sheikh Jarrah og Silwan, kastes palestinske beboere ut av sine boliger som overtas av israelske settlere. Dette skjer etter avgjøerelser av israelske domstoler ... der disse israelsk lov brukes ... en lov som gir jødiske eiere fra før 1948 rettigheter som for tilsvarende eierskap ikke gis til ikke-jødiske eiere.

Utkastelsene pågår ... og for disse områdene tydeligvis etter en israelsk plan om å presse ut flere og flere av de som bor der ... og som må betegnes som en sakte etnisk rensing.

Det er mye som kan sies om de juridiske krumspringene som Israel her benytter seg av.
De er særdeles tvilsomme.
Dette er godt beskrevet i rapporten fra "Peace Now" av 6. juni 2018, se under Kilde under dette blogginnlegget.
 
Det er internasjonal oppmerksomhet om disse utkastelsene som må til for å stoppe dem.
Og her er det snakk om ikke bare å kle av israelske juridisk uholdbare krumspring ... men å markere at dette følger vi med på og fordømmer.
Norge har da et spesielt ansvar som medlem av UNSC.
UD kan ta et initiativ i samarbeid med FNs spesialutsending Tor Wennesland.

Roman Abramovich: Avkledd

Den såkalte "oligarken" Roman Abramovich er nå blitt HELT AVKLEDD.

Fra før var det rimelig klart hvordan han under Russlands oppløsning "stjal" til seg med spesielle metoder Russlands store verdier innen olje og aluminium ... under ordningen "Loans for Shares" satt opp av Boris Yeltsin.

Han etablerte seg i London under Englands tvilsomme ordning med "Gylne Visa".

Og kjøpte bl.a. fotballaget Chelsea ...

Men da UK etterhvert begynte å be gylne visa-holdere om detaljer i deres rikdom ... da forlot Abramovich England.

Han forsøkte å etablere seg i Sveits...  men ga opp dette ... og havner da i Israel.

Nå i 2020 er han blitt helt avkledd  ...  ref de siste avsløringer fra nå i september kalt "FinCEN Leaks" om bankenes  transaksjoner de senere år.

BBC skriver om disse lekkasjene:

"The FinCEN Files are another big leak of secret files, detailing the failure of major global banks to stop money laundering and financial crime. They also expose how the UK is often the weak link in the financial system and how London is awash with Russian cash.  (BBC 20.sep 2020)

De er i disse siste lekkasjene det fremkommer mer info om Abramovich:
Han er en hemmelig donor til ELAD ... organisasjonen i Jerusalem som bl.a. skviser ut palestinere fra deres hjem der.
Slik kommer stjålne verdier til "nytte".
 
Og normalt vill man si: Stakkars Chelsea som er havnet inn i disse sirklene.
Men for Chelsea er det blitt motsatt ... der dytter nå Abramocich inn store summer til spilleroppkjøp.
Det er et kjent grep å forsøke  å vaske dubiøse penger med oppkjøp av og satsing på engelske fotballklubber.
For å forbedre et ødelagt image ...

Anlegging av PARK skviser ut palestinerne

Å erklære områder for PARK er er velbrukt middel i Israels "krigføring" mot palestinerne.
Det fins mange eksempler på dette historisk ... men det etableres stadig nye parker ... og det uten hemninger.
Et ferskt eksempel er parken ved Ein Haniya-kilden syd for Jerusalem.
Parken ble åpnet for 2 år siden men raskt stengt:
"Ein Haniya is a large natural spring on Jerusalem’s southern edge. 
Two and a half years ago, the city finished refurbishing the spring and inaugurated the area as a park in a gala ceremony.
But the park was closed immediately afterward because police refused to grant it a license until a nearby military checkpoint was moved to a location that would prevent Palestinians from accessing the park." 
(Haaretz 10.6.2020.
Man stenger altså en park for å få flyttet et IDF-sjekkpunkt lenger vekk ... slik at palestinerne der IKKE kan komme til den nyanlagte parken ... dette til tross av at  deler av den er på deres eiendom ... og der de har brukt kilden lenge.
Klarere kan vel ikke apartheid demonstreres?

Men så var der også mer som måtte ordnes:
"Recently, however, the two agencies resumed preparations to finally open the park to the public. 
These preparations included what the city termed “removing eyesores” – namely, the four buildings owned by Al-Walaja residents, as well as several huts that serve the village’s farmers." (Haaretz 10.6.2020).

Der var noen hus langs veien som var ... "sår for øynene å se på".
Så da river man dem uten videre:

Uten rivingstillaelse ...ja faktisk mens Israels Høyesterett hadde lagt ned forbud mot riving .... så bare kjører man fram bulldoserne:
"All the buildings, including the huts, were razed without a demolition order and without their owners being given advance notice." (Haaretz 10. juni 2020)

Det er når man går inn i slike konkrete eksempler man ser dybden i angrepene på palestinerne, deres land og rettigheter. Og hvor systematisk ... med alle virkemidler .... blir palestinere fortrengt og utelukket fra sine eiendommer.
Hvilke ord skal man bruke når slikt skjer metodisk?
Det er vel liten tvil om at dette er  ... apartheid?

Demonisering ... Begynner alltid med ordene


Demoniseringen begynner alltid med ordene ... anførselstegnene ... de såkalte.
Pompeo går lenger:
"In change, US describes East Jerusalem Palestinians as 'Arab residents'"

FØR var det palestinere som bodde i Øst-Jerusalem.
NÅ er det blitt:
 "Arabere/ikke-israelske  innbyggere med Jerusalem-ID-kort  utstedt av israelske myndigheter".

Slik er ordlyden i den ferske offisielle amerikanske MENNESKERETTS-oversikten.
Men det er håp: 
Enn så lenge er der ikke krav om at ID-en skal bæres synlig på klærne.
