The choice before us: International law or a ‘rules-based international order’?
Her diskuterer John Dugard det president Biden skrev i 2022 om saken, da gjaldt det krigen i Ukraina.
Han introduserer slik:
"1. Introduction
On 2 June 2022 President Biden published an op-ed in the New York Times
titled ‘How the US is willing to help Ukraine’ in which he declared
that Russia’s action in Ukraine ‘could mark the end of the rules-based
international order and open the door to aggression elsewhere, with
catastrophic consequences the world over’.Footnote 1
There is no mention of international law. Later, in a press conference
at the conclusion of the June 2022 NATO Summit Meeting in Madrid, he
warned both Russia and China that the democracies of the world would
‘defend the rules-based order’ (RBO).Footnote 2
Again, there is no mention of international law. On 12 October 2022 the
US President published a National Security Strategy which makes
repeated reference to the RBO as the ‘foundation of global peace and
prosperity,’Footnote 3 with only passing reference to international law.Footnote 4
The term ‘rules-based order’ is so frequently used by American
political leaders, such as President Biden and Secretary of State Antony
Blinken, that, according to Professor Stephen Walt of the Kennedy
School of Harvard University, it ‘seems to have become a job requirement
for a top position in the US foreign policy apparatus’.Footnote 5
The clear inference to be drawn from this is that the failure to invoke
international law and instead to appeal on most occasions to a
‘rules-based international order’ on the part of the United States is
considered and deliberate.Footnote 6
What is this creature, the ‘rules-based international order’, that
American political leaders have increasingly invoked since the end of
the Cold War instead of international law? Is it a harmless synonym for
international law, as suggested by European leaders? Or is it something
else, a system meant to replace international law which has governed the
behaviour of states for over 500 years?"

Sadly, since then events have gradually confirmed this, culminating in the recent cancellation of UNRWA funding by the collective West - led by the US - which is the starkest and most cynical confirmation that this prism is unfortunately correct."
Et videre utdrag:
"Yet that's exactly what they did. A mere few hours after the ICJ ruling they cut UNRWA's funding. I believe that as of this writing we're at 10 Western states having done so, with the US having initiated the move, followed by its henchmen. So in effect we have proponents of the "rules-based order" yet again in a frontal assault against international law."
Det USA-ledede angrepet på UNRWA, straks ICJ-dommen var klar, er egentlig et sterkt angrep på ICJ.
ICJ- dommerne skal forstå hva som gjelder i praksis.
USA ved president Bush har tidligere "angrepet ICC" ved loven som kalles "Invade Hague Act" fra august 2002, se Kilde.
Konklusjonen må bli:
Ifølge USA skal dommerne i Haag, både ICJ og ICC vise respekt for USA.
